Where you choose a MyCircle Home pricing option for your home phone and maintain local and long distance service from us you may be eligible for discount pricing on local calls, national long distance calls, fixed-to-mobile calls and/or international long distance calls (to specified eligible destinations) from your service to other active ACN fixed line and mobile customers, including ACN business customers (‘ACN-2-ACN Calling’).
We aim to provide a quality service and competitive offer to all our customers and ensure that no customers are disadvantaged by the behaviour of others. Our offer and your use of ACN-2-ACN Calling is subject to ACN’s ACN-2-ACN Calling Reasonable Use Policy (‘RUP’) which is summarised below:
Excessive Use
Where we identify that your use of ACN-2-ACN Calling is excessive, we may, at our discretion, choose to apply standard call rates to the excess calls or minutes of use (as applicable) or refuse you access to the offer. If we refuse you access to the offer we will then charge you our standard rates (as per your Service Plan) for all calls or minutes of calling which otherwise would have been eligible for the offer.
i) ACN-2-ACN Local Calling
Where you choose a MyCircle Home Plan which offers ACN-2-ACN Local Calling you will be eligible for discount pricing on local calls from your service to other active ACN fixed line customers.
ACN will consider your use of ACN-2-ACN Local Calling to be unreasonable if your local calls exceed 1000 calls in any month.
ii) ACN-2-ACN National Calling
Where you choose a MyCircle Home Plan which offers ACN-2-ACN National Calling you will be eligible for discount pricing on national long distance calls from your service to other active ACN fixed line customers.
ACN will consider your use of ACN-2-ACN National Calling to be unreasonable if your accrued minutes of ACN-2-ACN national long distance exceed 3000 minutes in any month.
iii) ACN-2-ACN Home to Mobile Calling
Where you choose a MyCircle Home Plan which offers ACN-2-ACN Home to Mobile Calling you will be eligible for discount pricing on fixed-to-mobile calls from your fixed line service to any active ACN GSM Mobile services.
ACN-2-ACN Home to Mobile Calling is an offer whereby the first five minutes of certain eligible fixed-to-mobile calls are free and you will only pay for the minutes of duration beyond the first five minutes. For a fixed-to-mobile call to be eligible for ACN-2-ACN Calling discounts the GSM Mobile service to which the call is made must be active with ACN at the time of the call. There may be a delay in transferring, connecting or activating a service. We are not responsible for any delay.
ACN will consider your use of this offer to be excessive if your accrued minutes of free calling under this offer exceeds 1000 minutes in any monthly invoicing period.
iv) ACN-2-ACN International Calling to New Zealand
Where you choose a MyCircle Home Plan which offers ACN-2-ACN Calling to New Zealand you will be eligible for discount pricing on direct-dial Trans-Tasman international long distance calls originated from your Fixed Line service to other ACN customers in New Zealand. For an international long distance call to be eligible for ACN-2-ACN Calling discounts the New Zealand toll (long distance) service must be active with ACN at the time of the call. We are not responsible for any delay in transferring, preselecting or registering these services to ACN.
ACN-2-ACN Calling to New Zealand provides discounted calling to a maximum of sixty (60) minutes of duration per call. Standard rates apply to all minutes of duration thereafter. An aggregate maximum of two hundred (200) minutes of ACN-2-ACN Calling to New Zealand per service, per monthly invoicing cycle applies. All minutes of duration beyond the maximum aggregate allowance are charged at standard rates. The aggregate maximum duration will be calculated pro rata where the invoicing period is less than one full month.
Reasonable Use
We supply the Service for the purpose of you making and receiving for your own personal use.
We will consider your use to be unreasonable if you:
i) make or receive calls on our network other than for your personal use;
ii) wholesale usage (including transit, refile or aggregate domestic or international traffic) on our network; or
iii) use the service in connection with a device that switches or re-routes calls to and from our network or the network of any Supplier;
without first obtaining our written consent. We may give or withhold our consent, or make consent subject to conditions, in our discretion.
We will also consider your use of the service to be unreasonable if you set up switch devices that may potentially allow a line to be kept open limiting the ability of other customers to access our network.
Without limiting our rights under the General Terms or our rights under our Service Description, where we consider your use of the offer to be unreasonable then we may suspend or cancel your service, in each case immediately and without notice to you.
Please note that our right to suspend or cancel the service without notice to you under this RUP over-rides any requirement we may have to give you notice in our Standard Form of Agreement.
